10 Common Questions

The 10 most common questions I've been asked over the last 35 years

You pay nothing unless we win. No upfront costs. No office visit required. No pressure—just a promise to fight for justice... for you and your family.

1. Do I have a strong case?

If you were injured or lost a loved one due to someone else's negligence, you may have a strong case, especially if the negligence is clearly documented.

2. How much is my case worth?

Value depends on the unique facts of each case. Generally, the presumptive value of wrongful death is about $1 million for the loss of love, comfort and affection. Additionally, you may be entitled to compensation for vehicle damage, funeral expenses, loss of decedent’s future earnings, and the loss of household services decedent would have provided.

3. How long will the legal process take?

Because of the seriousness of fatal accidents, it takes police about 3 to 9 months to finish their investigation. Multi-vehicle collisions, criminal investigations and decedent’s toxicology reports also contribute to the timeline.

4. What are the legal fees and costs?

We have a “no fee guarantee.” You pay nothing (no fees or costs) unless we win your case. Our fees are a percentage of the settlement and as low as 25% for “minors” claims. And we cover all costs, so you never pay one cent for legal fees or costs out of pocket.

5. Should I speak to insurance companies

We advise against talking to third-party insurance companies without talking to us first.

6. What evidence is important to my case?

Critical evidence includes medical records, accident reports, photos of the scene, vehicles and your physical and/or emotional injuries, witness statements, and proof of lost income.

7. What steps should I take after an accident?

Your primary focus is “always” on your recovery. Keep a diary and document your physical and emotional injuries, limitations and progress.

8. Why won’t the police talk to us?

This is the most common question we hear from surviving families. They have questions... but the police won’t provide any answers. Police must conduct a full, thorough and neutral investigation into the cause of an accident, and they don’t want to give the appearance that the family is directing or controlling the investigation. Even well-meaning questions like asking about nearby cameras can be seen as an attempt to influence the investigation. When police do speak with families, they usually only provide general and vague information and refuse to answer direct questions.

9. How likely is a settlement vs. going to trial?

About 95% of all claims in California are settled out of court. But if your case goes to trial... we’re ready to fight for the compensation you deserve.

10. What is the role of a wrongful death lawyer?

We will champion your cause for justice and make sure your voice is heard. We handle all the legal matters related to your loved one’s accident. We will negotiate with insurance companies, lienholders and protect your rights. One of areas that is really important to us is that our clients understand the process.
